On this date, the Court issued an
Order granting Apple Inc.’s
Motion to Compel Arbitration, dismissing without prejudice all member
cases, and denying as moot Apple Inc.’s Motion to Dismiss Pursuant to Rule
12(b)(7).
September 22, 2011
On this date, the Court held a
Status
Conference. Defendants have until October 20, 2011 to file
Motions (or Renewed Motions) to Compel Arbitration. Plaintiffs’ Opposition
is due on November 21, 2011. Defendants’ Replies are due on December 12,
2011. Oral Argument will be held on January 12, 2012 at 2:00 p.m.
November 17, 2010
On this date, the Court issued an
Order granting Defendant
Apple Inc’s Motion to Stay Plaintiffs’ Claims Against
Defendant Apple, Inc. Accordingly, all of Plaintiffs’ claims as to both
Defendants are stayed until the United States Supreme Court issues its
opinion in AT&T Mobility LLC v. Concepcion.
November 3, 2010
On this date, the Court held a
Status Conference
during which counsel for Plaintiffs and counsel for Defendant AT&T
agreed to stay the portion of the case that relates to Plaintiffs’ claims
against AT&T in light of the case pending before the United States Supreme
Court, AT&T Mobility LLC v. Concepcion.

On this date, the Court issued
Pretrial Order #11 which
extended the briefing schedule for pleadings related to motions filed in
response to the amended complaints. The order also reset the next in-court
hearing for Thursday, January 6, 2011 at 9:30 a.m.

extended the briefing schedule for pleadings related to motions filed in
response to the amended complaints. The order also reset the next in-court
hearing for Thursday, October 28, 2010 at 9:30 a.m.

On this date, the Court issued
Pretrial Order #9 which outlines
the schedule for filing amendments to the individual complaints and for
filing pleadings related to the amended complaints. Also, pursuant to this
order Plaintiffs’ First Amended Complaint was stricken from the record.

On this date, the Court held an in-court status conference in this matter. The
Court also issued a
Minute Entry, which
established important deadlines regarding amending individual
complaints.

On this date, the Court issued
Pretrial Order #8 which discusses
the duties and responsibilities of the Plaintiffs’ Steering Committee.

On this date, the Court issued Pretrial Order
#7 which outlines the scope of discovery in this matter and the filing
schedule for the proposed exemplar complaint. Also, pursuant to this
order, the next status conference will be held in Judge Carl J. Barbier's
courtroom on Thursday, May 13, 2010 at 9:30 a.m.

On this date, the Court issued Pretrial Order
#6. Pursuant to this order, the following individuals are appointed to
the Plaintiffs' Steering Committee: John R. Climaco; Stephen Barnett
Murray; Ronnie G. Penton; Virginia E. Anello; David M. Cialkowski; J.
Andrew Meyer; Brian R. Strange; and Timothy G. Blood. Also, pursuant to
this order, there will not be a Plaintiffs' Executive Committee appointed
in this matter.
