This multidistrict litigation consists of 12 cases pending before this Court. In these actions, the plaintiffs have alleged that Apple and AT&T have engaged in deceptive marketing with respect to the availability of multimedia message service functionality on the iPhone 3G and 3GS.

The Judicial Panel on Multidistrict Litigation assigned this multidistrict proceeding to Judge Carl J. Barbier of the United States District Court for the Eastern District of Louisiana to coordinate discovery and other pretrial matters in the pending cases. Subsequent Apple iPhone cases filed in federal court will ordinarily be transferred to this district court to become part of MDL No. 2116 as "Tag Along" cases. Upon the conclusion of discovery and other pretrial matters, cases that constitute MDL No. 2116 will be transferred back to the federal district courts from which they originated for the trial and further proceedings.
