Discovery Deadline
Motions to compel must be filed and resolved prior to the expiration of the discovery deadline.
Meet and Confer
Pursuant to Federal Rule of Civil Procedure 37(a)(1), a motion to compel disclosure or discovery “must include a certification that the movant has in good faith conferred or attempted to confer with the person or party failing to make disclosure or discovery in an effort to obtain it without court action.” The Rule 37(a)(1) Certificate of Conference accompanying a Motion to Compel must specify:
(1) who participated in the conference; (2) the date and time of the conference; (3) whether the conference was conducted by phone or in person; (4) the duration of the conference; (5) the specific topics that were addressed at the conference; and (6) whether any issues were resolved by the parties, and, if so, the terms of the resolution. Counsel should meet and confer either in person, by video conference, or by telephone. Email exchanges are not sufficient.
Oral Argument
Requests for Oral Argument must be filed as a separate statement pursuant to Local Rule 78.1. If the Court determines that oral argument may be helpful, the Court will issue a separate order setting oral argument for a specific date and time.
It is the duty of the party that has filed a motion to notify the Court if the motion has been resolved before the scheduled hearing date so that the matter may be removed from the Court's docket. Such notifications should be sent to efile-dossier@laed.uscourts.gov, cc’ing all counsel of record.
Expedited Consideration
Parties requesting expedited consideration of a matter should email a courtesy copy of their motion to efile-dossier@laed.uscourts.gov and call chambers (leaving a voicemail if after-hours) to advise that a motion for expedited consideration has been filed.
Parties may obtain available settlement conference dates by contacting chambers, but they should be mindful that available dates tend to be booked quickly and far in advance. Before representing to the District Court that no settlement conference dates are available within the applicable timeframe, parties must request a telephone status conference with Judge Dossier to discuss any scheduling difficulties.
