Pursuant to 28 U.S.C. § 2071, notice is given that the United States Court of Appeals for the Fifth Circuit is considering amending 5TH CIR. R. 27.3 and promulgating new rule 5TH CIR. R. 27.3.2 as shown in the attached PDF document. Proposed changes are “redline text.” We will accept written comments for consideration on the proposed change through Oct. 25, 2024. On September 18, 2024, the Honorable Lance M. Africk informed President Joseph Biden that he intends to retire from regular, active service as a U.S. district judge effective October 1, 2024. For over two decades, Judge Africk has served as a district judge for the Eastern District of Louisiana, in addition to one decade as a magistrate judge. He intends to retain a full staff and docket as a senior judge. Judge Africk’s letter to President Biden can be read here.
